Apa itu kaveat?<br />
<br />
Berjumpa lagi kita dalam soal hartanah. Hari ini ingin saya kongsikan satu perkara yang selalu diperkatakan apabila bercerita tentang hartanah iaitu kaveat. Kaveat adalah sekatan atau pendaftaran halangan untuk sebarang urusniaga ke atas sesebuah hartanah. Tidak kira samada melibatkan urusan lelong, pembelian hartanah "sub sale" atau hartanah baru. Apabila kaveat didaftarkan atas sesebuah hartanah menyebabkan pemilik berdaftar tidak boleh membuat sebarang urusniaga terhadap tanah berkenaan semasa tempoh kaveat. Kaveat juga mekanisme yang disediakan oleh undang-undang untuk melindungi kepentingan seseorang ke atas urus niaga hartanah miliknya.<br />

Terdapat empat jenis kaveat yang dinyatakan di dalam Akta Kanun Tanah Negara 1965 (Bab 19, Bahagian 1).<br />
<br />
1. Kaveat Pendaftar. Kaveat jenis ini yang didaftarkan oleh Pendaftar ke atas Dokumen Hakmilik. Menurut Seksyen 320, antara tujuan kaveat jenis ini adalah untuk melindungi hak-hak pemilik tertentu dan juga berkaitan dengan hak-hak kerajaan. Ia juga untuk menghalang dari urus niaga yang tidak wajar dan penipuan.<br />
<br />
2. Kaveat Persendirian. Sekatan atasan hartanah yang dimasukkan oleh individu atau sebuah badan yang mempunyai kepentingan ke atas pemilikan hartanah tersebut. Menurut Seksyen 322 Kanun Tanah Negara telah memperuntukkan pendaftaran kaveat yang menyatakan "sesiapa yang mempunyai kepentingan yang boleh didaftarkan, bolehlah memasuki suatu kaveat persendirian untuk melindungi kepentingan mereka."<br />

3. Lien Kaveat. Kaveat cagaran atau pegangan atas satu dokumen hakmilik. Kebiasaan kaveat jenis ini didaftarkan oleh Bank atau syarikat pinjaman untuk menjaga kepentingan mereka setelah sesebuah hartanah dicagarkan atau disandarkan kepada mereka. Perkara ini disebut dalam Seksyen 330 dalam Akta Kanun Tanah Negara 1965.<br />

4. Kaveat Amanah. Didalam Seksyen 332 pula menyatakan tentang kaveat amanah ini. Kaveat ini dimasukkan oleh pendaftar ke atas mana-mana individu atau badan yang memegang amanah ke atas milikan tersebut.<br />
<br />
Apabila kita terlibat dalam satu urusniaga samada jualbeli, sewa atau pajakan sesebuah hartanah, kaveat ini adalah sesuatu yang amat penting untuk diperhatikan. Kita boleh melihat bukti kaveat pada dokumen hakmilik. Dengan itu, anda dinasihatkan untuk mendapatkan carian geran terbaru di Pejabat Tanah untuk melihat status samada hartanah itu mempunyai kaveat atau tidak. Ini kerana banyak kes berlaku apabila pembeli hartanah telah membuat bayaran pendahuluan tanpa melihat status terbaru, tetapi pertukaran hakmilik tidak dapat dilakukan kerana terdapat sekatan atau kaveat atas hartanah tersebut. Ada kemungkinan duit pendahuluan anda akan hilang amat besar.<br />
<br />
Tempoh sekatan atau kaveat persendirian adalah selama 6 tahun, ia akan secara automatik akan terbatal selepas tempoh itu. Namun semua kaveat yang didaftarkan boleh ditarik balik atau dibatalkan oleh pengkaviet dengan hanya membuat pembatalan di Pejabat Tanah. Kaveat juga boleh dibatalkan dengan perintah mahkamah.<br />

Sebut sahaja nasi arab semua orang tahu. Nasi Arab bukan lagi asing di negara kita yang sememangnya kaya dengan pelbagai jenis makanan yang enak-enak dan lazat malah restoran nasi arab ini tumbuh umpama cendawan selepas hujan di negara kita. Ada lebih kurang 10 buah restoran bertemakan menu padang pasir ini di sekitar Kajang dan juga Bangi.</div>

Selasa lepas, saya membeli nasi arab untuk makan malam bersama keluarga. Saya dan anak memilih nasi arab Kabsah ayam dan suami pula nasi arab Kabsah kambing. kami memang pelanggan tetap nasi arab di Foodcourt Uniten Bangi. Harga pun sangat berpatutan. Mula-mula dulu saya kurang gemar makan nasi arab disebabkan tiada sambal yang pedas-pedas tetapi mungkin kerana kerap kali menemani suami yang gemar ke restoran nasi arab, lama-lama saya boleh terima masakan timur tengah ini dan kini ianya merupakan makanan kegemaran kami sekeluarga. Kalau 2-3 minggu tidak makan nasi arab sudah terasa rindu.<br />

Bila bertanya pada rakan-rakan tentang nasi arab ni, masing-masing ada cerita dan restoran nasi arab pilihan masing-masing. Namun rata-rata akan mengatakan restoran Sa'ba di Cyberjaya adalah pilihan utama. Pernah makan di Restoran Sa'ba tu, memang ramai orang. Kalau datang waktu tengahari, kena tunggu meja kosong baru boleh makan. Makan nasi arab ni memang sedap tapi tidak boleh amalkan selalu sebab boleh 'koyak' dompet namun kalau orang belanja boleh je selalu. Haha :)</div>

Jika anda mempunyai perancangan untuk membeli lot banglo berikut adalah 10 panduan membeli lot banglo untuk mengelakkan anda daripada tertipu @ timbul masalah-masalah di masa akan datang.</span><br />

Anda digalakkan untuk membeli lot banglo di lokasi yang sudah ada banglo dibina. Ini adalah petunjuk paling selamat kerana lokasi tersebut memang dibenarkan untuk membina banglo dan pastikan lokasi bukan kawasan rendah atau ada laluan air serta bukan kawasan curam atau kawasan yang tidak sesuai untuk membina banglo.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">2- Namun jika pilihan anda seperti di atas kebiasaanya lot banglo tersebut dijual dengan harga yang agak mahal. Jadi jika budget anda sederhana maka anda boleh membeli lot banglo yang belum dipecahkan kepada individu title atau geran individu dan akan dilakukan pada masa hadapan. Kebiasaan pemaju atau pemilik tanah akan menghantar perancangan pecah lot bersama penukaran status tanah kepada pembangunan kepada pihak pejabat tanah daerah. Lot-lot banglo seperti ini banyak ditawarkan untuk dibeli. </span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">3- Jika anda ingin membeli tanah atau lot banglo lebih murah dan berani untuk mengambil risiko, anda boleh membeli lot banglo yang berkongsi nama dalam geran. Ianya tidak digalakkan tetapi jika anda yakin dan mempunyai wang tunai serta boleh berkongsi bersama adik beradik atau saudara- mara ia boleh dilakukan. Namun perlu diingatkan tanah tersebut tidak boleh dicagarkan kepada bank atau membuat pinjaman kerajaan.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">4- Bagi keluasan minimum lot banglo pula, anda digalakkan membeli lot banglo paling kurang 3500 kaki persegi atau 4000 kaki persegi atau keluasan tanah paling ideal adalah 5000-6000 kaki persegi. Bagi yang mempunyai budget lebih bolehlah membeli 8000-10000 kaki persegi. Tidak digalakkan membeli Semi-D lot seluas 1800-2500 kaki persegi. Ia akan ada masalah untuk kelulusan dan pembinaan rumah pada masa akan datang.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">5- Adalah paling baik jika dapat membeli 1 ekar tanah dalam 1 geran tersendiri kerana menurut Akta Kanun Tanah Negara, anda dibenarkan untuk membina 1 buah rumah atas 1 ekar tanah tanpa mengubah status tanah pertanian kepada pembangunan. Rumah banglo anda siap dengan dusun dapat dibina dengan keluasan tanah tersebut.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">6- Zonning adalah perkara perlu anda tahu jika membeli lot banglo. Anda boleh membuat semakkan di Majlis Perbandaran samada lot banglo yang ingin anda beli berada di dalam zonning perumahan atau kawasan perancangan perumahan. Ini penting, jika tidak termasuk dalam zonning perumahan maka nanti status perumahan atau pembangunan yang dipohon agak sukar untuk didapati. Zonning biasanya hanya akan disemak semula 5-10 tahun sekali oleh pihak Majlis Perbandaran.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">7- Perancangan pecah lot atas tanah oleh pihak pemaju juga perlu diperhatikan. Sesetengah pemaju kecil tidak ikut spesifikasi majlis perbandaran, ia akan menjadi masalah pada masa hadapan apabila lot banglo yang dijual berubah sempadan. Memang akan menjadi masalah besar, ada kemungkinan anda perlu memecahkan sebahagian rumah banglo yang dibina sebab telah termasuk sempadan tanah milik orang lain.</span></span><br />
<span style="font-family: Arial, Helvetica, sans-serif;"><br style="background-color: white; color: #222222;" /><span style="background-color: white; color: #222222;">8- Infra adalah perkara paling penting semasa membeli lot banglo. Jika lot banglo sekelompok perlu ada rezab jalan 40-60 kaki persegi (bergantung pada majlis Perbandaran), tanah lapang, TNB, longkang, tangki air dan sistem pembentungan. Anda perlu ambil tahu dan mendapat kepastian daripada mereka atau pemaju yang membuat pecah lot tersebut. Banyak lot banglo yang dijual tidak meletakkan perkara ini sebagai perkara asas.</span></span><br />

Perlu ada jangka masa serahan geran individu dan ketahui hak anda terhadap tanah yang telah dibeli. Sesetengah pemaju membuat kerja separuh jalan, tinggalkan pembeli dalam keadaan tergantung tidak bertali dan tiada apa-apa hak ke atas tanah. Anda digalakkan berhati-hati dalam pemilihan pemaju atau individu apabila membeli lot banglo.</span></span><br />

Penceritaan satu watak ke satu watak dan seterusnya berkembang menjadi satu kisah yang menarik dengan gaya bahasa yang santai dan bersahaja ditambah dengan penceritaan naskhah hikayat Melayu lama Mimpi Kembang Dahlia terserlah keindahan kesusasteraan Melayu melalui bahasa klasik dan syair umpama rempah ratus yang sempurna di dalam novel ini.<br />

Kisah antara Zaweeya dan Wafi Ikhmal, Ungku Izzaidah dan Hidayati, Haikal dan Siti Solehah, Kembang Dahlia dan Putera Indera Laksamana masing-masing memegang peranan dengan baik sekali bergabung dalam satu cerita kekeluargaan dan persahabatan, benci dan dendam, kasih dan sayang.<br />
